Cet article s’interroge sur le statut épistémologique des fictions employées en théorie politique, dont l’état de nature constitue l’un des cas exemplaires. Contre les critiques relativistes et celles d’inspiration marxiste , on montre que l’utilisation des fictions obéit à des règles précises du point de vue de leur finalité et de leur justification, ce qui interdit de considérer toutes les fictions comme équivalentes. Cette problématique est illustrée à partir de la théorie des fictions développée par le philosophe néokantien Hans Vaihinger (...) et en la comparant avec l’usage des fictions tel qu’on le trouve illustré dans les écrits scientifiques et politiques de Thomas Hobbes .This article addresses the question of the epistemological status of fictional discourse in political theory, the « state of nature » being one of its paradigmatic examples. Against both relativism and Marxist critiques , it is argued that the use of fiction obeys to well-defined rules from the point of view of their finality and justification, which forbids us to consider all fictions as equivalent. This problem is illustrated by means of a presentation of the theory of fictions developed by the Neo-Kantian philosopher Hans Vaihinger and by comparing it to the use of fictions as found in the scientific and political writings of Thomas Hobbes. This book offers an interpretation of the rise of secular historical thought in nineteenth-century Europe. Instead of characterizing 'historicism' and 'secularization' as fundamental breaks with Europe's religious heritage, they are presented as complex cultural permutations with much continuity; for inherited theological patterns of interpreting experience determined to a large degree the conditions, possibilities, and limitations of the forms of historical imagination realizable by nineteenth-century secular intellectuals. This point is made by examining the thought of the German theologian W. M. L. (...) de Wette and that of the Swiss-German historian Jacob Burckhardt. Burckhardt's meeting with de Wette and his subsequent decision to study history over theology are interpreted as revealing moments in nineteenth-century intellectual history. By examining their encounter, its larger historical context, and the thought of both men, the book demonstrates the centrality of theological concerns and forms of knowledge in the emergence of modern, secular historical consciousness. Two of his major works, The Age of Constantine the Great (1852) and The Civilization of the Renaissance in Italy (1860), bear out this claim. In his Constantine Burckhardt deals with the transition from late pagan antiquity to the early Christian Middle Ages, and in his more famous Renaissance he deals with the transition from the late Middle Ages to the beginnings of secular modernity. In the [End Page 149] latter, as is well known, he established one of the most compelling and creative theses in the history of modern historiography, virtually creating the “idea of the Renaissance” that has long influenced both scholarly and popular conceptions of that period. 3What elicited Burckhardt’s interest in crises and transitions in general and in these two periods of crisis and transition in particular? In this article, I shall argue that there is a strong relationship between Burckhardt’s own historical experience in the early and mid-nineteenth century and his choice of subject and mode of analysis in these two monumental works. In theoretical terms one observes a “dialectical” form of objectivity in the execution of Burckhardt’s historiographical tasks: a structural affinity or kinship between subject (Burckhardt, his historical experience) and object (late antiquity, Renaissance) predisposes Burckhardt to his theme/argument and thus provides a key to understanding the genesis and the character of insights that he offers in these two works. 4 To establish this point I shall focus on the category of religion, on Burckhardt’s own experience of questions of religious truth and skepticism in the nineteenth century, and on his treatment of religion in these two works.The Young Jacob Burckhardt and ReligionReligion is a crucial but often neglected aspect of Jacob Burckhardt’s thought. 5 Like a number of nineteenth-century German intellectuals, Burckhardt was a Pfarrersohn, a “pastor’s son.” 6 He grew up in a profoundly conservative Protestant environment in Basel, nicknamed “pious Basel” for its dogged resistance to the “ideas of 1789” and for its earlier heritage of Reformation and pietist religiosity. During Burckhardt’s youth in fact, his father was a children’s minister and head-deacon (Obersthelfer) before becoming in 1838 the city cathedral’s Antistes, the highest and most prestigious ecclesiastical office in Basel. In short, as his biographer Werner Kaegi has noted, Burckhardt’s early [End Page 150] upbringing and education were strongly shaped by the world of his father, a world of “old Protestant piety.” 7Following his father’s example, Burckhardt started out on the clerical track, studying theology at the University of Basel. However, during his Theologie-studium (1837–39) he experienced a profound crisis of faith brought on by an encounter with German historical biblical criticism and liberal theology represented in the person of W. M. L. de Wette (1780–1848). A radical theologian and biblical scholar, de Wette had wound up in Basel in 1822 after being dismissed from the University of Berlin for holding views considered heterodox and politically threatening by the conservative Prussian government. 8 In a letter to his friend Johannes Riggenbach written in August 1838 Burckhardt tells how de Wette’s critical theology had unseated his faith. “In my eyes,” Burckhardt wrote,de Wette’s system grows in stature every day; one simply must follow him, there is no alternative; but every day a part of our traditional church doctrine melts away under his hand. The thesis that republicanism was only suited for small states was given its decisive eighteenth-century formulation by Montesquieu, who emphasized not only republics' need for homogeneity and virtue but also the difficulty of constraining military and executive power in large republics. Hume and Publius famously replaced small republics' virtue and homogeneity with large republics' plurality of contending factions. Even those who shared this turn to modern liberty, commerce and the accompanying heterogeneity of interests, however, did not all agree with or (...) know about Publius' institutional responses to the problems of executive and military power. Throughout the late eighteenth and early nineteenth centuries, and on both sides of the Atlantic, it remained a live question whether large states could be stable moderate republics, with responses ranging from embraces of Montesquieuian limited monarchy, to denials that there was any real large-republic problem at all, with a variety of institutional solutions in between for those who thought there was a real but soluble large-republic problem. This paper poses the question “Why did Augustine not use his Trinitarian theology to better effect in the Pelagian controversy?” I demonstrate first that Augustine’s mature Trinitarian theology would be directly relevant to the Pelagian discussions after the year 415. Second, I show a slight progression in Augustine’s treatment of relevant issues from 418 through the end of his life in his anti-Pelagian corpus. I argue that Augustine does not use his Trinitarian theology to his full advantage in the anti-Pelagian (...) corpus. I suggest that Augustine avoided these connections at least in parí because the Trinitarian reflections on “God is love” (I Jn 4) would ultimately push the anti-Pelagian reflections on God’s love for Jacob (Rom 9:13) towards universalism, but Augustine had already rejected universalism. Post-Structuralist Discourse Theory analyzes political ideas and action from a Marxist direction. However, while classic Marxian sociology is rooted in economic processes that “structure” society and ideas, Post-Structuralist Discourse Theory emphasizes the absence of any determinative principle. Thus, it radicalizes an ongoing shift in Marxism away from economic essentialism towards indeterminacy, contingency, and openness. The ideological superstructure becomes ever more important at the expense of the economic base; class struggle and relations of production lose analytical and strategic purchase in favor (...) of a complex and integral form of politics; there are no deeper, natural foundations determining how society is organized and structured. Post-Structuralist Discourse Theorists argue that this orientation leads to a more satisfactory analysis of political practice than is possible through positivist research. Assessing this claim requires a survey of the hermetic terminology in which Post-Structuralist Discourse Theorists express their ideas—the discourse, as it were, of Discourse Theorists—exploring their use of sociology, structuralist linguistics, psychoanalysis, and the political theory of populism. Poststructuralist discourse theory is enjoying increasing recognition for its potential to contribute to the study of institutional change and continuity. Yet the most fruitful approach to realizing this potential has hitherto not been found. The main proposition so far has been to operationalize DT’s insights and concepts by adopting them into the framework of discursive institutionalism. However, an ongoing debate about the compatibility of the ontologies underlying DT and DI has cast doubts over whether such a combination is theoretically feasible. (...) The critical literature review in the first part of this article indeed finds insurmountable ontological differences between the discourse-theoretical and the discursive-institutionalist traditions, as their clashing notions of what is understood as a ‘discourse’ result in diverging views on power, agency, and subjectivity. Instead of merging DT into DI, I suggest to empower the former as a self-sufficient paradigm for institutional analysis. To achieve this, the second part of this article re-articulates the ‘logics framework’ proposed by Jason Glynos and David Howarth into a middle-range theory for the study of institutionalization and politicization in a discourse-theoretical fashion. The purpose of this re-articulation is to dispel various arguments against the viability of an autonomous poststructuralist approach to institutions. (shrink)

ABSTRACT Ever since an intense theoretical debate over a decade ago, the concept of heterogeneity has had a well-established place within poststructuralist Discourse Theory. It captures the interactions between the heart of the space of representation and its margins, between excluded excess and manifest presence; and conceptualizes particularities, differential remainders, and discursive exteriority. The analytical implications of heterogeneity remain underexploited, however. This contribution makes the case that one way to operationalize the notion of heterogeneity in empirical research is by tracing (...) its strategic effects. Since heterogeneity constitutes ‘the primary terrain within which homogeneizing logics operate’, heterogeneous dynamics like the ‘incorporation of new demands’ and ‘the exclusion of others who were previously present’ affect and shape the availability and feasibility of political strategies. This contribution first provides an extensive definition of heterogeneity drawing on the original debate that gave the concept prominence. An approach that captures and explains the strategic effects of heterogeneity is then developed through the integration of heterogeneity into the logics framework. Finally, this approach is illustrated through an exploration of the politics of international trade. (shrink)

Thomas Hobbes (1588-1679) was an English philosopher, remembered today for his work on political philosophy. His 1651 book Leviathan established the foundation for most of Western political philosophy from the perspective of social contract theory. He also contributed to a diverse array of fields, including history, geometry, physics of gases, theology, ethics, general philosophy, and political science. He was one of the main philosophers who founded materialism. He visited Florence in 1636 and later was a regular debater in philosophic (...) groups in Paris, held together by Marin Mersenne. Hobbes's first area of study was an interest in the physical doctrine of motion and physical momentum. Despite his interest in this phenomenon, he disdained experimental work as in physics. He built a good reputation in philosophic circles and in 1645, he was chosen with Descartes, Gilles de Roberval and others, to referee the controversy between John Pell and Longomontanus over the problem of squaring the circle. His other works include: The Elements of Law Natural and Politic (1640) and De Cive (The Citizen): Philosophical Rudiments Concerning Government and Society (1651). (shrink)

La géométrie souterraine est une science mathématique pratique, qui se développe dans les exploitations minières et dont la diffusion est considérablement modifiée au cours du xviiie siècle. Ce phénomène est lié à l’institutionnalisation graduelle de la discipline, de l’établissement d’un système de compagnonnage à la création d’académies des mines. Progressivement, les pratiques vont faire appel à de nouvelles méthodes et intégrer une solide formation en mathématiques théoriques. La circulation et l’enseignement des connaissances sont dans un premier temps basés sur un (...) système de manuscrits qui sera étudié en détail. L’exemple du Markscheider August Beyer (1677-1753) illustre ce processus collectif de constitution et de transmission de connaissances, dont la diffusion est cependant contrôlée. Nous analysons dans un second temps l’évolution des vecteurs de circulation et son influence sur la discipline, en nous appuyant sur la biographie de deux mathématiciens saxons, J.A. Scheidhauer (1718-1784) et son discipline J.F. Lempe (1757-1801). Leurs parcours croisés symbolisent la transformation de la discipline. Le passage à l’imprimé, la publication d’articles dans des revues spécialisées et la création de chaires académiques font de la géométrie souterraine une science reconnue qui reste cependant en dehors du corpus de connaissances et des débats universitaires. Desde una perspectiva histórica se intenta aportar elementos que clarifiquen la problemática sobre la mundialización y la confrontación de las culturas jurídicas. Así, por una parte, se ofrece una interrogación acerca de la manera en que se practica la teoría del derecho en el mundo anglosajón y en el continental europeo, lo cual conduce a poner en cuestión su pretensión de universalidad. Por otra parte se analiza y discute el estatus y la pertinencia de ciertas teorías del derecho, como la (...) del legal origins theory, que afirman la superioridad del common law sobre el resto de las culturas jurídicas. Se destaca además la necesidad de introducir la dimensión sociológica para la comprensión del fenómeno jurídico. (shrink)

La conception fodorienne de la psychologie scientifique soulève les trois problèmes suivants qui peuvent, je crois, être résolus. La condition de formalité est-elle compatible avec l'existence de lois psychologiques intentionnelles ? L'atomisme sémantique est-il compatible avec le fonctionnalisme? L'atomisme sémantique est-il compatible avec la systématicité des pensées humaines? Dans les trois premières sections du présent article, j'essaie de résorber ces tensions. Dans la quatrième et dernière section, j'examine la conception des attributions de croyance développée par Fodor dans « Substitution Arguments (...) and the Individuation of Beliefs » selon laquelle la relation de croyance est une relation à quatre places entre une personne, un symbole , un rôle fonctionnel et un contenu propositionnel. Je fais valoir que Fodor est confronté à un dilemme : soit le rôle fonctionnel est un déterminant du contenu propositionnel, et Fodor doit rejeter l'atomisme sémantique; soit le rôle fonctionnel est un déterminant de l'efficacité causale d'un symbole, et il doit amender la condition de formalité.Fodor's views about scientific psychology raise three puzzles : Is the Formality Condition compatible with there being intentional psychological laws ? Is Content Atomism consistent with Fonctionalism? Can Content Atomism be reconciled with the claim that human thoughts are systematic? In the first three sections of this paper, I try and show how to solve the three puzzles. Finally, in the fourth section, I examine Fodor's recent view of belief-ascriptions in "Substitution Arguments and the Individuation of Beliefs" according to which the belief relation is a four place relation between a believer, a symbol token , a functional role and a propositional content. I argue that Fodor faces a dilemma : either the functional role is a determinant of content, in which case Fodor must reject Content Atomism; or it is a determinant of the causal efficacy of the vehicle, in which case he must amend his Formality Condition. Since a few decades, policy evaluation is a main topic in Western democracies. lt identifies, measures and appreciates effects, outcomes and impacts of a policy. Yet, there is not a common way to institutionalise that policy instrument; one can observe many differences in terms of its intensity and maturity, as well as a diversity of institutional device. Compared to other countries, Belgium is characterized by a low visibility and weak decisional impact of evaluation. Public demand for enlightening state action rarely (...) takes the form of a demand for evaluation. The word 'Evaluation' is frequently pronounced, but most often in a political sense.In this article three types of arguments can be put forward to explain this Jack of evaluation: a lacking commitment of Parliament and political staff, the fragmentation and weak autonomy of the civil service and the domination of political parties upon the Belgian political and administrative system. Et pour cause, dans le sillage des sciences empiriques, la pensée juridique moderne s'est accommodée d'une épistémologie d'après laquelle toute proposition juridique est réputée vraie ou fausse si elle décrit un état de chose « réel ». Conçu comme un ensemble de faits sociaux, objectivement identifiables, le droit s'appréhende comme une discipline promouvant des idéaux scientifiques, dont la neutralité axiologique de l'observateur. Dans ces conditions, la (...) valeur, indémontrable puisqu'elle n'est pas un fait, est renvoyée aux confins du droit. Cet ouvrage vise à souligner l'articulation fondamentale entre la discipline juridique et le concept de valeur qui en constitue le pivot, et à proposer une définition juridiquement satisfaisante de cet objet central pour le droit.
